In Nebraska, the age of sexual consent is 16. Penalties for these misdemeanor or felony charges depend on the type of offense and the age of the alleged suspect and victim. In addition to these penalties, a conviction subjects an individual to mandatory sexual offender registration:
1st Degree Sexual Assault: Includes without consent, or in which the assailant knew or should have recognized a mental or physical disability, or with a victim age 12-15 and a perpetrator 19 years or older. Charged as a Class II felony, punishable between 1-50 years in prison for a first offense, a minimum of 25 years for a repeat offense.
2nd Degree Sexual Assault: Includes sexual contact with serious personal injury without consent or if the perpetrator ignored a mental or physical disability. Charged as a Class IIA felony, with up to four years' incarceration, two years' post-release supervision, and $25,000 fine.
3rd Degree Sexual Assault: Sexual contact without consent or ignoring a physical or mental disability, which did not result in serious personal injury. Charged as a Class I misdemeanor, with up to six months in prison and fine of $1,000.
